Confidentiality of the Social Insurance Company

Abstract

The article analyses regulations concerning legal protected confidentiality of the Social Insurance Company (ZUS) – the institution involved in non-agricultural social insurance (so-called universal system of social security). First, the legal status of the institution has been presented, the scope of its activities, structure and governing bodies. Then, legal regulations relating to the subjective scope of legally protected confidentiality of ZUS and its objective scope. The analysis includes of confidentiality of information relating to candidates for the position of the President of the Company obtained during the recruitment process by members of the recruitment team, as well as those regulations which refer to disclosing data collected in the accounts of the insureds and accounts of contribution payers covered by special confidentiality, which may be generally called social security confidentiality. The article point out the shortcomings of the applicable regulations and formulates relevant de lege ferenda postulates.
