Abstract

The gloss concerns the Supreme Court judgement relating to one of the fundamental issues, i.e. the right to defence in enforcement proceedings. The SC judgement was passed with respect to establishing the obligation of the defence counsel to take part in the meeting concerning continued application of a preventive measure. The author of the gloss shared the SC view and presented additional arguments in favour of its rightness.
